That workflow does not exist on the open web and does not exist in any Scale-produced dataset. It only exists inside employees’ work computers. If the data wall is real, and Epoch AI says it is, “data from inside the house” becomes the new moat for frontier labs.
Meta captured its own pipeline first. It is the most expensive decision Meta could have made in terms of trust with its workforce, and simultaneously the most rational in terms of competitive survival of the model.

Meta published its position under Bosworth and Stone’s names, defended it through global press coverage, and will deploy it without regulatory friction in the United States because American labor law allows this kind of capture with notification rather than explicit consent. “Workflow capture for productivity agent training” has just become a standard legal phrase.
One detail the official coverage soft-pedaled and the contract-writing community should not: when employees asked whether they could opt out of MCI, Bosworth answered in writing that there is no opt-out on corporate equipment. Gary Marcus picked that line up as the epigraph of the moment: “There was no option to opt out.” That is the sentence that ends up cited next year in the first legal case against a SaaS vendor with an MCI-style clause — because Meta has now established the standard that “capture for AI” does not require individual consent if the equipment is corporate. - BPO and outsourcing contracts. If your company uses call centers, data entry, or offshore engineering, the vendor on the other side is watching this week how Meta justified the capture, and will try to include matching language. The BPO business model over the next 24 months depends on automating roughly 60% of the team. The training data for that automation comes from recording 100% of it today.
- Third-party AI agent seats. The one-week audit
If your company is a net buyer of SaaS tools, AI agents, or outsourced services — and it is — there are three things that do not wait until the next renewal cycle.
Reopen every TOS for vendors that ship with an embedded AI agent. Search the section usually titled “Data Usage” or “Product Improvement.” If the vendor reserves the right to record your personnel’s activity to train AI, send it to legal with a note that you need a written opt-out before the next payment. If the vendor refuses, the refusal itself is useful information about the vendor.
Write the internal standard that defines which AI tools are permitted to record workflow from which teams. Not as compliance policy. As the document that is missing from 9 out of 10 vendor inventories we have seen. “We know Salesforce ships with Agentforce but we do not authorize workflow capture” has to be written, not intuited. The week somebody sues a vendor because an agent learned from a private lead, the thing that saves your company is the piece of paper with a prior date on it.
Review your existing outsourcing contracts, especially with nearshore and BPO vendors. Ask explicitly: does your operation record activity on our projects for internal AI training? If the answer is ambiguous, treat it as an operational red flag. Not because the vendor is malicious, but because they probably have not documented it yet and do not know a client is about to ask.
The full audit takes less than a week if the vendor list is already current. The cost of skipping it is that in six months you discover a vendor you considered neutral trained an agent on how your team operates, packaged it, and is selling it to your competitor. At that point there is no clause left to add; there is only an MSA to renegotiate from a weaker position.

The frame is not Meta
The mainstream take this week will be “how cynical, Meta is recording the very employees it is about to lay off.” It is true and it is accurate. And it is the wrong frame.
The correct frame is that the data wall became real this week, and the market for workflow data opened wide the moment the first large company wrote the public-facing contract that the rest will copy while nobody is paying attention. The conversation at your company next quarter will not be “Meta did an ugly thing.” It will be “my CRM vendor updated its TOS and there is a new Data Usage section that was not there before.” Your choice is whether you sign it unread or hand it back with annotations.
That choice does not require new technology. It requires legal hours, CTO hours, and one week of doing an exercise that nobody has done yet. The work is cheap now. In October it will be expensive, or irreversible.
